1. Acceptance of Terms

By downloading, accessing, or using FindAnyItem, you agree to these Terms, our Privacy Policy, and all applicable laws. These Terms apply to all users, whether on Free, Pro, or Premium subscription tiers.

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or in-app notification.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you meet this age requirement.

You may not use the App if:

• You are prohibited by law from using such services
• Your account has been previously suspended or terminated
• You are a competitor or use the App for competitive purposes

3. Account Registration

To use FindAnyItem, you must:

• Create an account using Google Sign-In or Apple Sign-In
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities under your account. We are not liable for losses due to unauthorized use of your account, unless caused by our gross negligence.

4. Services Provided

FindAnyItem provides:

• Box Inventory Management: Digital tracking of physical storage boxes
• QR Code System: Generate and scan QR codes for boxes
• AI-Powered Item Detection: Photo recognition via Google Gemini API
• Location Management: Organize boxes by physical location
• Search Functionality: Find items across all boxes
• Smart Suggestions: AI-based recommendations for item pairing
• Data Export: Export your inventory data in JSON format

Service availability and features may vary by subscription tier and region. We reserve the right to modify, suspend, or discontinue any service with 30 days notice.

5.4 Ad-Supported Scans

All subscription tiers (including Free, Pro, and Premium) have access to ad-supported scans. If you run out of your monthly AI scan allocation, you can watch advertisements to earn additional scans.

Pricing and features subject to change with 30 days notice to paid subscribers.

6. Payment and Billing

• Payment Methods: Subscriptions are processed via Apple App Store (iOS) or Google Play Store (Android)
• Subscription Period: Monthly or annual, as selected during purchase
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• Cancellation: You may cancel anytime through your app store account settings. No refunds for partial periods.
• Price Changes: We will notify you 30 days in advance of price changes. Continued use after the notice constitutes acceptance.
• Refunds: Managed by Apple App Store or Google Play Store per their policies. Contact the respective store for refund requests.
• Taxes: Prices may exclude applicable taxes, which will be added at checkout as required by law.

7. User Responsibilities

You agree to:

• Use the App lawfully and ethically
• Not upload illegal, offensive, or infringing content
• Not attempt to hack, reverse-engineer, or disrupt the App
• Not scrape data or use automated tools without permission
• Not impersonate others or misrepresent affiliation
• Not use the App for any unlawful purpose
• Maintain accurate account information
• Report security vulnerabilities responsibly

8. Intellectual Property

The App, including its design, features, code, and content, is owned by FindAnyItem and protected by intellectual property laws.

Your Content: You retain ownership of content you upload (item descriptions, etc.). By uploading, you grant us a license to process and store it for service provision.

Our Content: You may not copy, modify, distribute, or create derivative works from our App without written permission.

9. AI Features Disclaimer

• No Guarantee of Accuracy: AI recognition is provided "as-is." Results may vary based on image quality, lighting, and object type.
• No Liability for Errors: We are not responsible if AI misidentifies items or provides incorrect suggestions.
• Photo Processing: Photos sent to Gemini API are processed in real-time and immediately discarded. We do not store any photos.
• Opt-Out: If you prefer not to use AI features, manually enter item names instead of using the camera.

10. Disclaimers and Warranties

We do not guarantee:

• Uninterrupted or error-free operation
• Accuracy of AI recognition
• Compatibility with all devices
• Data integrity or prevention of data loss

You use the App at your own risk. We recommend regular data exports as backups.

Some jurisdictions do not allow disclaimer of implied warranties, so this may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

• Lost data or inability to access your inventory
• Errors in AI recognition or smart suggestions
• Damages from hacking, downtime, or service interruptions
• Third-party actions (e.g., Apple, Google, Gemini API)

Our total liability is limited to the amount you paid in the last 12 months, or $100, whichever is less.

We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, lost items).

Some jurisdictions do not allow limitation of liability, so this may not fully apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the App
• Violation of these Terms
• Infringement of third-party rights
• Unlawful or harmful content you upload

This means if someone sues us because of your actions, you will cover our legal costs.

13. Termination

13.1 By You

You may delete your account anytime through the Account screen. This permanently deletes all your data. See our Account Deletion Guide for instructions.

13.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Required by law
• The App is discontinued

13.3 Effect of Termination

Upon termination, your data will be deleted within 90 days (backup retention period). No refunds for paid subscriptions.

14. Dispute Resolution

• Governing Law: These Terms are governed by applicable laws, without regard to conflict of law principles.
• Arbitration: Any disputes will be resolved through binding arbitration, not court litigation, except for intellectual property claims and small claims court disputes (under $10,000).
• Class Action Waiver: You agree not to participate in class actions. All disputes must be resolved individually.

15. Miscellaneous

• Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement.
• Severability: If any provision is invalid, the rest remain in effect.
• No Waiver: Failure to enforce a term does not waive our right to enforce it later.
• Assignment: You may not transfer these Terms. We may assign them to a successor.
• Force Majeure: We are not liable for delays due to events beyond our control (natural disasters, wars, pandemics).
• Language: English version controls in case of translation discrepancies.
